1. ההסכם
תנאים אלה חלים על השימוש שלכם באפליקציית גוצ׳ה קונקט ובאתר (יחד: ”השירות“). פתיחת חשבון או שימוש בשירות מהווים הסכמה להם. אם אינכם מסכימים, אל תעשו שימוש בשירות.
2. מי רשאי להשתמש בשירות
עליכם להיות בני 18 לפחות וכשירים להתקשר בחוזה מחייב. ניתן להירשם כלקוחות המחפשים עזרה, או כנותני שירות (”מבצעים“) המציעים אותה.
3. החשבון שלכם
מסרו פרטים מדויקים בעת ההרשמה ושמרו אותם מעודכנים. אתם אחראים לכל פעולה המתבצעת בחשבונכם ולשמירת סודיות הסיסמה. הודיעו לנו מיד אם עולה חשש שהחשבון נפרץ. ניתן למחוק את החשבון בכל עת מתוך האפליקציה.
4. מהי גוצ׳ה — ומה אינה
גוצ׳ה היא זירה המפגישה בין לקוחות למבצעים. איננו צד להסכם שאתם עורכים עם משתמש אחר. איננו מעסיקים את המבצעים, איננו מפקחים על השירותים שהם מבצעים, איננו מנהלים או שולטים בהם, ואיננו ערבים לאיכותו, לבטיחותו, לחוקיותו או לעמידה בלוח הזמנים של שירות כלשהו, ואף לא לכך שעבודה כלשהי תתקבל או תושלם.
אף שאנו עשויים לבצע בדיקות מסוימות לגבי מבצעים, איננו מתחייבים כי בדיקה כלשהי היא ממצה או כי משתמש כלשהו הוא אכן מי שהוא טוען שהוא. הפעילו שיקול דעת עצמאי, כפי שהייתם עושים בהתקשרות עם כל בעל מקצוע. המפגש וההתנהלות מול משתמשים אחרים הם באחריותכם בלבד.
5. תשלומים
גוצ׳ה אינה מבצעת סליקה או תשלומים ואינה גובה עמלה דרך האפליקציה. המחיר, אמצעי התשלום ומועדו מסוכמים ישירות בין הלקוח למבצע, וכל מחלוקת בעניין התשלום היא ביניהם.
6. התוכן שלכם
הבעלות בטקסט, בתמונות, בסרטונים ובהקלטות שאתם מפרסמים נותרת שלכם. אתם מעניקים לנו רישיון לא בלעדי, עולמי וללא תמלוגים לאחסן, לשמור, לשכפל, לתרגם ולהציג תוכן זה לצורך הפעלת השירות וקידומו. הרישיון מסתיים עם מחיקת התוכן או החשבון, למעט תוכן שכבר שותף עם משתמש אחר או שאנו נדרשים לשמרו על פי דין.
אתם מאשרים כי בידיכם הזכויות בכל מה שאתם מפרסמים, וכי אין בו כדי לפגוע בזכויות של אחר.
7. ביקורות
ביקורת חייבת לשקף התנסות אמיתית. אין לפרסם ביקורות פיקטיביות, ביקורות בתשלום או ביקורות נקמניות, ואין להציע דבר בתמורה לביקורת. אנו רשאים להסיר ביקורות המפרות כללים אלה.
8. שימוש מותר
אתם מתחייבים שלא:
- להשתמש בשירות לכל מטרה בלתי חוקית, מרמתית, מטרידה, גזענית או מפלה
- להתחזות לאדם אחר או להציג מצג שווא לגבי כישוריכם, רישיונותיכם או הסמכותיכם
- לפרסם תוכן פוגעני, מאיים, או הפוגע בזכויותיו או בפרטיותו של אחר
- להעביר שיחות מחוץ לפלטפורמה במטרה לעקוף את כללינו, או לפנות למשתמשים בהצעות מסחריות שאינן קשורות
- לבצע גריפה, סריקה או הנדסה לאחור, או לנסות להשיג גישה בלתי מורשית לשירות או לחשבון של משתמש אחר
- להעלות תוכנות זדוניות או לשבש את פעולת השירות או אבטחתו
9. דיווחים ואכיפה
ניתן לדווח על משתמש או על ביקורת מתוך האפליקציה. אנו רשאים לברר, להסיר תוכן ולהשעות או לסגור חשבון המפר תנאים אלה — במקרים חמורים, ללא הודעה מוקדמת.
10. זמינות השירות
אנו רשאים לשנות, להשעות או להפסיק כל חלק מהשירות. אנו משתדלים לשמור על זמינותו, אך איננו מתחייבים שיפעל ללא הפרעות או ללא תקלות.
11. הגבלת אחריות לתוכן ולשירות
במידה המרבית המותרת בדין, השירות ניתן כמות שהוא (”AS IS“) וכפי שהוא זמין, ללא אחריות מכל סוג, מפורשת או משתמעת, לרבות אחריות משתמעת לסחירות, להתאמה למטרה מסוימת או לאי־הפרה.
12. הגבלת חבות
במידה המרבית המותרת בדין, גוצ׳ה לא תישא באחריות לנזק עקיף, מקרי, מיוחד, תוצאתי או עונשי, ולא לאובדן רווחים, נתונים או מוניטין, הנובעים משימושכם בשירות או מכל התקשרות בינכם לבין משתמש אחר. אין בתנאים אלה כדי להגביל חבות שאינה ניתנת להגבלה על פי דין.
13. שיפוי
אתם מתחייבים לשפות את גוצ׳ה בגין תביעות, הפסדים והוצאות סבירות הנובעים משימושכם בשירות, מהתוכן שלכם או מהפרת תנאים אלה.
14. דין וסמכות שיפוט
על תנאים אלה יחולו דיני מדינת ישראל, ולבתי המשפט המוסמכים בתל אביב–יפו תהא סמכות שיפוט ייחודית, ללא תחולת כללי ברירת הדין.
15. שינויים בתנאים
אם נשנה תנאים אלה נעדכן את התאריך בראש העמוד, ובמקרה של שינוי מהותי נודיע על כך גם באפליקציה. המשך השימוש בשירות לאחר השינוי מהווה הסכמה לו.

1. Agreement
These Terms govern your use of the Gotcha Connect mobile app and website (together, the “Service”). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.
2. Who may use the Service
You must be at least 18 years old and able to enter into a binding contract. You may register either as a customer looking for help, or as a service provider (“Tasker”) offering it.
3. Your account
Give accurate information when you register and keep it current. You are responsible for what happens under your account and for keeping your password confidential. Tell us promptly if you believe your account has been compromised. You may delete your account at any time from within the app.
4. What Gotcha is — and is not
Gotcha is a venue that introduces customers to Taskers. We are not a party to any agreement you make with another user. We do not employ Taskers, we do not supervise, direct or control the services they perform, and we do not guarantee the quality, safety, legality or timeliness of any service, nor that any job will be accepted or completed.
While we may carry out limited checks on Taskers, we do not warrant that any check is exhaustive or that any user is who they claim to be. Use your own judgement, as you would when hiring anyone. Meeting and dealing with other users is at your own risk.
5. Payments
Gotcha does not process payments and takes no commission through the app. Price, payment method and timing are agreed directly between the customer and the Tasker, and any dispute about payment is between them.
6. Your content
You keep ownership of the text, photos, videos and audio you post. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, translate and display that content for the purpose of operating and promoting the Service. This licence ends when you delete the content or your account, except where it has already been shared with another user or where we must retain it by law.
You confirm you have the rights to everything you post, and that it does not infringe anyone else's rights.
7. Reviews
Reviews must reflect a genuine experience. Do not post fake, paid-for, or retaliatory reviews, and do not offer anything in exchange for a review. We may remove reviews that break these rules.
8. Acceptable use
You agree not to:
- Use the Service for anything unlawful, fraudulent, harassing, hateful or discriminatory
- Impersonate another person, or misrepresent your skills, licences or qualifications
- Post content that is obscene, threatening, or infringes someone's rights or privacy
- Take conversations off-platform in order to evade our rules, or solicit users for unrelated commercial purposes
- Scrape, crawl, reverse-engineer, or attempt to gain unauthorised access to the Service or another user's account
- Upload malware, or interfere with the operation or security of the Service
9. Reports and enforcement
You can report a user or a review from within the app. We may investigate, and may remove content or suspend or terminate an account that breaks these Terms — in serious cases, without notice.
10. Availability
We may change, suspend or discontinue any part of the Service. We try to keep it available but do not promise it will be uninterrupted or error-free.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, Gotcha will not be liable for indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, data or goodwill, arising out of your use of the Service or out of any dealing between you and another user. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnity
You agree to indemnify Gotcha against claims, losses and reasonable costs arising from your use of the Service, your content, or your breach of these Terms.
14. Governing law
These Terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv–Jaffa will have exclusive jurisdiction, without regard to conflict-of-law rules.
15. Changes to these Terms
If we change these Terms we will update the date at the top of this page, and where the change is significant we will tell you in the app. Continuing to use the Service after a change means you accept it.

1. Accord
Les présentes conditions régissent votre utilisation de l’application mobile et du site web Gotcha Connect (ensemble, le « Service »). En créant un compte ou en utilisant le Service, vous les acceptez. Si vous ne les acceptez pas, n’utilisez pas le Service.
2. Qui peut utiliser le Service
Vous devez être âgé d’au moins 18 ans et capable de conclure un contrat. Vous pouvez vous inscrire soit comme client à la recherche d’aide, soit comme prestataire de services qui en propose.
3. Votre compte
Fournissez des informations exactes lors de votre inscription et tenez-les à jour. Vous êtes responsable de ce qui se passe sous votre compte et de la confidentialité de votre mot de passe. Prévenez-nous sans délai si vous pensez que votre compte a été compromis. Vous pouvez supprimer votre compte à tout moment depuis l’application.
4. Ce qu’est Gotcha — et ce qu’il n’est pas
Gotcha est un espace de mise en relation entre clients et prestataires. Nous ne sommes pas partie aux accords que vous concluez avec un autre utilisateur. Nous n’employons pas les prestataires, nous n’encadrons, ne dirigeons ni ne contrôlons les services qu’ils réalisent, et nous ne garantissons ni la qualité, ni la sécurité, ni la légalité, ni la ponctualité d’un service, pas plus que l’acceptation ou l’achèvement d’une mission.
Même si nous pouvons procéder à des vérifications limitées sur les prestataires, nous ne garantissons pas qu’une vérification soit exhaustive, ni qu’un utilisateur soit bien la personne qu’il prétend être. Exercez votre propre jugement, comme vous le feriez pour toute embauche. Rencontrer d’autres utilisateurs et traiter avec eux se fait à vos propres risques.
5. Paiements
Gotcha ne traite aucun paiement et ne prélève aucune commission via l’application. Le prix, le moyen de paiement et les délais sont convenus directement entre le client et le prestataire, et tout litige relatif au paiement les concerne seuls.
6. Vos contenus
Vous restez propriétaire des textes, photos, vidéos et enregistrements audio que vous publiez. Vous nous accordez une licence non exclusive, mondiale et gratuite pour héberger, stocker, reproduire, traduire et afficher ces contenus aux fins d’exploiter et de promouvoir le Service. Cette licence prend fin lorsque vous supprimez le contenu ou votre compte, sauf lorsque le contenu a déjà été partagé avec un autre utilisateur ou lorsque la loi nous impose de le conserver.
Vous confirmez détenir les droits sur tout ce que vous publiez et que ces contenus ne portent pas atteinte aux droits d’autrui.
7. Avis
Les avis doivent refléter une expérience réelle. Ne publiez pas d’avis faux, rémunérés ou de représailles, et n’offrez rien en échange d’un avis. Nous pouvons supprimer les avis qui enfreignent ces règles.
8. Utilisation acceptable
Vous vous engagez à ne pas :
- Utiliser le Service à des fins illicites, frauduleuses, de harcèlement, haineuses ou discriminatoires
- Usurper l’identité d’une autre personne, ou présenter de façon trompeuse vos compétences, licences ou qualifications
- Publier des contenus obscènes ou menaçants, ou portant atteinte aux droits ou à la vie privée d’autrui
- Poursuivre les échanges hors de la plateforme afin de contourner nos règles, ou solliciter des utilisateurs à des fins commerciales sans rapport avec le Service
- Extraire des données, explorer, faire de l’ingénierie inverse, ou tenter d’accéder sans autorisation au Service ou au compte d’un autre utilisateur
- Téléverser des logiciels malveillants, ou perturber le fonctionnement ou la sécurité du Service
9. Signalements et sanctions
Vous pouvez signaler un utilisateur ou un avis depuis l’application. Nous pouvons enquêter, et pouvons supprimer des contenus ou suspendre ou résilier un compte qui enfreint les présentes conditions — sans préavis dans les cas graves.
10. Disponibilité
Nous pouvons modifier, suspendre ou interrompre toute partie du Service. Nous nous efforçons de le maintenir disponible, mais nous ne promettons pas qu’il soit ininterrompu ni exempt d’erreurs.
11. Exclusions de garantie
Dans toute la mesure permise par la loi, le Service est fourni « en l’état » et « selon disponibilité », sans garantie d’aucune sorte, expresse ou implicite, y compris toute garantie implicite de qualité marchande, d’adéquation à un usage particulier ou d’absence de contrefaçon.
12. Limitation de responsabilité
Dans toute la mesure permise par la loi, Gotcha ne saurait être tenue responsable des dommages indirects, accessoires, spéciaux, consécutifs ou punitifs, ni d’une quelconque perte de bénéfices, de données ou de clientèle, découlant de votre utilisation du Service ou de vos échanges avec un autre utilisateur. Aucune disposition des présentes conditions ne limite une responsabilité qui ne peut être limitée par la loi.
13. Garantie d’indemnisation
Vous acceptez de garantir Gotcha contre les réclamations, pertes et frais raisonnables découlant de votre utilisation du Service, de vos contenus ou de votre manquement aux présentes conditions.
14. Droit applicable
Les présentes conditions sont régies par le droit de l’État d’Israël, et les tribunaux compétents de Tel-Aviv–Jaffa ont compétence exclusive, sans égard aux règles de conflit de lois.
15. Modifications des présentes conditions
Si nous modifions les présentes conditions, nous mettrons à jour la date figurant en haut de cette page et, lorsque la modification est significative, nous vous en informerons dans l’application. Continuer à utiliser le Service après une modification vaut acceptation de celle-ci.
